Office: CerviScreen AI, a product of Shri Sitaram Shiksha Evam Paryavaran Samaj Kalyan Samiti (Registered NGO), having its registered office at 33, Lalitpur Colony, Near Shankar Chowk, Lashkar, Gwalior, Madhya Pradesh (India) - 474001 hereinafter referred to as: CerviScreen.


These Terms of Use (“Terms”) govern the access to and use of CerviScreen’s AI-powered cervical cancer screening services (“Services”) provided through the CerviScreen platform, website, and associated applications. By accessing or using the Services, you (“Customer”, “User”, “Healthcare Provider”) agree to be bound by these Terms.

1. Eligibility

1.1 The Services are intended only for registered healthcare professionals (doctors, paramedics, or authorized clinical staff).

1.2 By using the Services, you confirm that you are legally authorized to provide cervical screening in your jurisdiction and have completed the onboarding process with CerviScreen.

2. Services Provided

2.1 CerviScreen provides a screening platform to assist in the preliminary detection of cervical abnormalities through image classification and reporting.

2.2 The additional AI-assistance within the Services are intended as a clinical decision-support tool and do not replace medical diagnosis, treatment, or consultation by a licensed physician.

2.3 Users acknowledge that final clinical decisions remain the sole responsibility of the healthcare professional.

3. User Responsibilities

3.1 Users shall ensure that all screening data, images, and records uploaded are accurate, authentic, and obtained with informed consent of the patient.

3.2 Users shall not misuse the Services for fraudulent, unethical, or unlawful medical practices.

3.3 Users are responsible for safeguarding their login credentials and account information.

3.4 Users agree to comply with all applicable laws, including data protection and medical ethics regulations.

4. Payments & Credits

4.1 Each screening is charged at the agreed per-screening rate finalized during organization onboarding.

4.2 Payments are governed by the Cancellation & Refund Policy.

4.3 Approved refunds are credited as CerviScreen Super Credits only, as per the refund terms.

5. Data Protection & Confidentiality

5.1 All patient and user data is handled in accordance with applicable data protection laws (including the Information Technology Act, 2000, and applicable healthcare privacy standards).

5.2 Images and medical records uploaded to CerviScreen are encrypted in transit and at rest.

5.3 CerviScreen shall not disclose patient-identifiable data to third parties except as required by law or regulatory authorities.

6. Limitations of Liability

6.1 CerviScreen provides doctor screening diagnosis feedback and AI-assisted outputs as a clinical decision-support tool only.

6.2 The Company does not guarantee 100% accuracy of AI outputs and shall not be liable for any clinical misinterpretation or patient outcome arising from sole reliance on the AI results.

6.3 Users acknowledge that final clinical responsibility lies with the treating healthcare professional.

6.4 To the fullest extent permitted by law, CerviScreen disclaims liability for indirect, incidental, or consequential damages arising from use of the Services.

7. Intellectual Property

7.1 All rights, title, and interest in the CerviScreen platform, algorithms, and associated intellectual property remain with the society ‘Shri Sitaram Shiksha Evam Paryavaran Samaj Kalyan Samiti’.

7.2 Users are granted a limited, non-exclusive, non-transferable license to use the Services during their active subscription.

8. Termination of Use

8.1 CerviScreen reserves the right to suspend or terminate access to Services if Users violate these Terms or misuse the platform.

8.2 Upon termination, all pending credits shall be forfeited, except where mandated by law or policy.

9. Governing Law & Dispute Resolution

9.1 These Terms shall be governed by and construed in accordance with the laws of India.

9.2 In case of disputes, Parties shall attempt amicable resolution within 30 days.

9.3 If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator mutually appointed by both Parties.

9.4 The seat and venue of arbitration shall be Gwalior, Madhya Pradesh, India, and proceedings shall be conducted in English.

9.5 Subject to arbitration, the courts at Gwalior, Madhya Pradesh shall have exclusive jurisdiction.
